On 29 July 1994 the Parliament of the Republic of Moldova adopted the Supreme Law of the Moldavian state - the Constitution. This fundamental legal act of the State contains the most important rules of our political system, guarantees political pluralism, and protects human rights and freedoms.
After decades of authoritarian rule and brutal social experiences, a regime characterized by the domination of the State in all areas, within which the individual has never represented a value in itself, the people of the Republic of Moldova chose national independence, parliamentary democracy and human rights. To achieve this goal, one of the first steps that our country made after the proclamation of the independence was the adoption of a democratic constitution, which guarantees human rights and fundamental freedoms, and protects citizens from abuses on the part of the State.
The Constitution of the Republic of Moldova, being a democratic one, places the power of the governed in the hands of citizens. This paradigm will remain an illusion as long as we don't have free citizens. Therefore, the State has the duty to contribute to the development of free individuals. Howsoever solemnly proclaimed, freedom will remain an illusion if there won't be any effective mechanisms to protect it. The Constitution of the Republic of Moldova provides for the entire set of such instruments. Therefore, the agents of the State have the fundamental duty to undertake its best endeavours in order for these mechanisms to work.
The Republic of Moldova has an experience that's not too long. Within the millennial history of the world civilization, the 25 years of independence of our state represent only a moment. In terms of ethnicity, culture, religion and spirituality, the people of the Republic of Moldova are not homogeneous. What led us, the citizens of Moldova, regardless of social background, ethnicity, religious beliefs, to proclaim in 1991, on the territory of the former MSSR, an independent state, was the desire for national freedom, the desire to be free, to decide our own destiny, to have a decent life, to be safe and the wish for human dignity to be a supreme fundamental value. And all these values are guaranteed by the Constitution. Therefore, the Constitution of the Republic of Moldova is the glue that must consolidate different groups of individuals in a single state.
The Constitution is not just a document whose application is reduced to the time in which lived those that adopted it. In the modern world, the Constitution is a document that complies with the „living tree" doctrine, which means that this fundamental and organic document must be read and understood in a gradual manner, adapted to the changes and the evolution of each society. In this context, the Constitution of the Republic of Moldova is a document that covers the social relations of those who lived when it was adopted and those living now, as well as of those who will live in the future.
The Constitution of Moldova was born in a historical period in which the political thought was dominated by the religion of human rights. This fact prompted the spirit of our constitution, which marked in a fundamental way the jurisprudence of the Constitutional Court in this quarter century of existence. Each time the Constitutional Court was asked to balance certain actions of the State and the observance of human rights, the Court has tipped the scales in favour of human rights.
Unfortunately today we are witnessing an attempt to change this view. In Europe, there are countries that have already stopped the mechanisms of the European Convention on Human Rights or are attempting to block the enforcement mechanisms of the judgments of the European Court. What we must all understand is that only by safeguarding constitutional values we can offer the future generations a chance to live in a free and prosperous society.
On the occasion of the 22nd anniversary of the adoption of the Constitution, on behalf of the Constitutional Court, I convey to all the most cordial greetings and wishes of prosperity, and I urge you, in everything we do, to contribute to the edification of a society governed by justice and truth, and let's honour, as we ought to, the Constitution!
