Message from the President of the Constitutional Court on the occasion of the professional holiday – Jurists’ Day

The professional Jurists’ day is a good opportunity to convey congratulation to all who practice law and through their daily activity, contribute to edifying the rule of law and perpetuating democratic values characteristic for a modern society.

The practical implementation of constitutional ideals which protect fundamental rights represents the mission of every jurist, and constitutional justice is one of the instruments that ensure the fulfillment of this mission.

One of the aims of constitutional justice is to contribute to improving the framework of human rights protection on a national scale. The task of the Constitutional Court in resolving the exceptions of unconstitutionality raised by the courts of all levels represents an effective evolution of the process of protecting human rights.

The concrete review by way of exception of unconstitutionality is the only instrument through which the citizen has the opportunity to defend himself against the legislator, in case he/she considers that by the adopted legal acts there has been an infringement of his/her constitutional rights. This indirect way, allowing citizens an access to constitutional justice, offers the possibility to the Constitutional Court, as guarantor of the supremacy of the Constitution, to exercise control over the legislative power in regards of the observance of the catalogue of fundamental rights and freedoms.

 

Remarking the undeniable role of jurists in protecting and promoting human rights, on behalf of myself and the Constitutional Court, I wish you working abilities, perseverance and inspiration in your professional activity. Or, in the words of the illustrious American jurist Oliver Wendell Holmes jr. - the prophecies of what the courts will do in fact, and nothing more pretentious, are the law”.
