2012 The Constitutional Court received the collection of judgments of the Federal Constitutional Court of GermanyThe Constitutional Court received as a gift the collection of 128 volumes containing all the judgments of the Federal Constitutional Court of Germany. The donation was made today by the German Foundation for International Legal Cooperation (IRZ Stiftung). At the donation receipt ceremony, Mr. Alexandru Tanase, the President of the Constitutional Court, stated that the authority of constitutional jurisdiction is involved in all aspects of the functioning of society, its activity being a reflection in the mirror of what is happening in public life. "In this respect, the Constitutional Court uses the Constitution as a tool for promoting human rights. Another important role is watchfulness of political pluralism functionality. The success of a Constitutional Court is directly dependent on the intellectual abilities of judges since a court exists through its judgments. Therefore, we have a "selfish" interest to gain knowledge and to deliver the best possible judgments. Within the context, the German expertise is an example worth following", said Mr. Alexandru Tanase. The IRZ Foundation Deputy Executive Director, Dr. Stefan Hülshörster, mentioned that the donation is a sign of good cooperation between Germany and the Republic of Moldova in the field of law. "The Constitutional Court has the difficult task of always being on edge between law and politics. Law and politics quite often intersect and in such situations, a constitutional court must have during examination the Constitution as unit of measurement. Certainly, the collection of judgments of the Federal Constitutional Court will not be a guide for walking on edge of a knife in the Republic of Moldova and will not offer patented solutions but the development directions and the content of judgments of the Federal Constitutional Court may provide argumentative support for significant constitutional issues", declared the IRZ Foundation representative. Stefan Hülshörster has expressed the willingness of IRZ Foundation to provide further support to Moldova in strengthening and developing the role of the Constitutional Court, too. Being present at the event, H.E. Dr. Berthold Johannes, Ambassador Extraordinary and Plenipotentiary of the Federal Republic of Germany to Moldova, underlined the indispensable role of the Constitutional Courts in the states' life as well as the rule of law as a factor of living. "Of course, the collection of judgments of the Federal Constitutional Court of Germany is not a direct guide for Moldovan colleagues but they can take over the best which has been established by the supreme judicial court in Germany over 60 years of activity", said the Ambassador. Being mandated by the German Federal Government, the IRZ Foundation consults and supports reforms in the legal system and the judiciary in many states worldwide. For some years, there is a very close and intensive cooperation with law enforcement bodies of the Republic of Moldova which includes, among others, areas of justice reform, procedural law, civil and commercial law, administrative law and that of administrative litigation, the whole area of criminal law, criminal procedural law and penitentiary system as well as advocacy and notary fields.
