CCM Delegation attends the Congress of the Association of Constitutional Justice of the Countries of the Baltic and Black Sea Regions

On 1 and 2 June 2017, the delegation of the Constitutional Court of the Republic of Moldova (CCM) participates at the 2nd Congress and the General Assembly of the Association of Constitutional Justice of the Countries of the Baltic and Black Sea Regions (BBCJ) which takes place in Harkiv, Ukraine.

CCM is represented by, Justice Aurel Băieşu and Ms Rodica Secrieru, Chief Assistant-Judge. The President of CCM in the period 2011-2017, Mr Alexandru Tănase is also participating at the Congress as a moderator of the session „National constitutional paradigm and generally recognised principles and norms of international law and EU law, judgments of international courts".

The general subject of the Second BBCJ Congress is „The Role of Constitutional Courts in Interpreting the Provisions of National Constitutions in the Context of Generally Recognised Principles and Norms of International Law and EU Law, Judgments of International Courts". The Congress gathers representatives of constitutional courts and international organizations from Europe and the U.S.A.

In his presentation CCM Justice Aurel Băieșu focused on state sovereignty and hierarchy of principles and norms unanimously recognized on the international level in the constitutional case-law. The magistrate pointed out that in its case-law CCM ruled that the international jurisdictional practice is binding for the Republic of Moldova as a state that joined the Convention for the Protection of Human Rights and Fundamental Freedoms. Therefore, according to the CCM representative „in an international society facing new challenges, the stability of constitutional justice becomes an axiom of democratic aspirations of any state."

The Congress will continue on Friday, 2nd of June, when the General Assembly of the Association members will take place. BBCJ was established in 2015 and includes as members the Constitutional Courts of Georgia, Lithuania, Moldova and Ukraine. CCM was the first of the founding courts to hold BBCJ's presidency from the moment of its foundation and until 31 December 2016, in its capacity of Court that initiated the Declaration on its establishment. On 1 January 2017, BBCJ's presidency was taken over by the Constitutional Court of Ukraine.
