A new subject entitled to lodge applications with the Constitutional Court

On April 15, 2016 in the Official Gazette of the Republic of Moldova was published Law no. 24 of 4 March 2016, by which have been amended, inter alia, Law no. 317-XIII of 13 December 1994 on the Constitutional Court and the Constitutional Jurisdiction Code no. 502-XIII of 16 June 1995. According to the amendments entered into force, the councils of first and second level administrative-territorial units were included in the list of subjects that have the right to lodge applications with the Constitutional Court. Previously this right was enjoyed only by the People's Assembly of Găgăuzia (Gagauz-Yeri).

Under the new provisions, the councils of first and second level administrative-territorial units are entitled to lodge applications with the Constitutional Court only with regard to reviewing the constitutionality of laws and other normative acts concerning the principles of local autonomy.

Pursuant to the recent amendments, the applications lodged with the Constitutional Court shall be circumscribed to the general conditions of admissibility provided by Article 24 of the Law on the Constitutional Court and Article 39 of the Constitutional Jurisdiction Code.
